Data Act Addendum
Manychat complies with the EU Data Act (Reg. 2023/2854) to give our EU customers control over their data. Under this law, EU customers may switch providers on two (2) months’ notice with at least a 30-day transition period. We will assist you throughout the transition: providing continued service, maintaining security and continuity, and helping you export your data. You are entitled to export your account data (flows, subscriber lists, etc.) in open formats (CSV, JSON, etc.). Manychat’s standard policy is that prepaid fees for unused service are non‑refundable.
EU-Only Scope and Legal Basis
This policy applies only to Manychat customers using our services within the EU/EEA. It is based on the EU Data Act (Regulation 2023/2854), which grants data portability rights. For reference, the Data Act (Reg. 2023/2854) is available on EUR-Lex here.
How to Switch Providers

Notice: To switch, send Manychat a written notice at least two (2) months before your intended switch date. (Contact us via support with your request.) In your notice, tell us if you are switching to another service or only deleting your data.

Transition Period: Once we receive your notice, Manychat will schedule a 30-day transition period to help you export your data. During this period, your account will remain accessible and operational for exporting your data and completing the transition, subject to the terms of your subscription plan. You may request a one-time extension of the transition (up to 7 months total) if you need more time. If 30 days is not feasible, we will notify you within 14 business days and agree on a reasonable extension (no more than 7 months total).

Assistance: Throughout the notice and transition, Manychat will assist you in good faith. We will: (a) help export your data (provide tools or guides); (b) maintain service continuity with our usual uptime and support; (c) keep data security at our standard high level; and (d) inform you of any known risks or issues. You are responsible for importing and securing your exported data in your new system.

Retrieval: After the transition, we allow a 30-day retrieval period to download any remaining data. At the end of that period, unless otherwise agreed, Manychat may delete your data except any we must legally retain.

What Data Can You Export
Under the Data Act, you can export all your “exportable data” from Manychat. This generally includes: your custom chat flows and sequences, subscriber/contact lists, user attributes, analytics/insights data, and any other content you stored in Manychat. We provide these in open, machine-readable formats (e.g., CSV and JSON) so you can import them into another service.
Data obtained through third-party integrations (for example, social network platforms or other partner services connected to Manychat) may not be available for export through Manychat, where such data originates, and may remain accessible through the respective third-party service. In accordance with Article 4 of the EU Data Act (Regulation 2023/2854), the obligation to make data available applies when the user cannot directly access it. Where the data remains accessible to the user directly through the original service provider or through another service integrating with that provider, Manychat may not be the data holder for those datasets and therefore may not provide a separate export of such data.
For the avoidance of doubt, this means that data originating from partner platforms (such as messaging content retrieved via integrations) remains accessible through those platforms or through other services that integrate with them.
All data that Manychat can export directly will be provided by Manychat Support in accordance with the requirements of the EU Data Act and in commonly used, machine-readable formats.
Fees and Refunds

Non-Refundable Subscription Fees: Our policy for EU customers is that paid subscription fees are non-refundable if you terminate early. This means if you prepaid for a term and switch before the end, the remaining unused portion is not returned automatically.

Temporary Switching Fees: If we incur third-party costs (e.g., data egress charges), we may pass those through until Jan 12, 2027, but we will inform you in advance. After Jan 12, 2027, per Article 29, all switching charges are prohibited (we will switch you free of charge).
Step-by-Step Migration Checklist
- Plan Your Switch: Decide on a switch date and notify Manychat at least 2 months in advance via support.
- Confirm Details: Specify if you are moving to a new provider or deleting data. Receive confirmation of your notice.
- Export Data: Use our export tools or guides to download all your data (flows, contacts, etc.) in CSV/JSON formats. If needed, request assistance from Manychat support for export.
- Data Transfer: Import your data into your new system or on-premise setup.
- Transition Period: Manychat remains active for 30 days (or longer if extended). Continue to manage your account until cutover.
- Retrieval: During the 30 days after transition, download any remaining data.
- Termination: The service will be considered terminated either upon successful completion of the switch (in which case Manychat will confirm completion) or at the end of the notice period if you choose to terminate without switching (in which case you may request data erasure). In either case, we will notify you when the service is terminated.

Do I get my money back if I leave early?

Can Manychat charge extra to switch?
Until Jan 12, 2027, Manychat may only charge documented data-transfer costs. After Jan 12, 2027, no switching fee is allowed by law. -

What exactly can I export?
